Powers of Attorney

There may come a time when you are not physically or mentally able to make decisions regarding your financial affairs or your welfare. To protect you in this situation, you can entrust someone to manage your affairs for you if the need arises via a Lasting Power of Attorney.

If you lose mental capacity to make your own decisions without a power of attorney in place, an application will need to be made to court for someone to be designated to act on your behalf. This is time consuming and expensive but most importantly, you have no control over who is making decisions for you.

What is a Lasting Power of Attorney?

A Lasting Power of Attorney is a legal document which gives people you name, called Attorneys, the power to help manage your affairs and make decisions on your behalf. If you lose capacity and do not have a Lasting Power of Attorney your family and friends have no legal authority to act for you. It is therefore essential to have your Lasting Powers of Attorney in place as soon as possible.

To remember:

Without an LPA your family and friends will not be able to deal with your financial and personal welfare affairs.

Choosing your Attorney

A person you appoint to act as your Attorney should be a person you trust as this involves a huge level of responsibility. A family member, a friend or even a professional such as a solicitor could act as your attorney. We recommend appointing more than one attorney and you can choose whether your attorneys act jointly, jointly, and severally or jointly for some decisions, jointly and severally for other decisions. We usually advise that you choose to let your attorneys act jointly and severally for practical reasons.

How do I put my Lasting Power of Attorney into legal force?

To put your Lasting Power of Attorney into legal force you must register your Lasting Power of Attorney with the Office of Public Guardian which is a government body in England and Wales. The Office of Public Guardian charge a registration fee, but this is not applicable for everyone depending on your financial situation.

We can register your Lasting Power of Attorney for you, and we recommend doing this immediately to prevent any delays further down the line as your Lasting Power of Attorney cannot be used until it has been registered.

Can I do my own Lasting Power of Attorney?

Yes – you can do your own Lasting Power of Attorney via the Office of Public Guardians website. We would always recommend you use a professional to create your Lasting Powers of Attorney due to the complication and common pitfalls people fall into.
